Los Angeles County Assessor John Noguez, in jail on charges of corruption since October 2012, made bail on Friday. Mr. Noguez stands accused of taking $185,000 in bribes from Ramin Salari, a prominent property-tax consultant and generous Noguez campaign fundraiser. Mr. Noguez is alleged to have lowered property-tax bills for some of Salari’s wealthy clients in exchange for those donations.
The Assessor has been collecting his salary of $197,000 a year since his incarceration, but has had difficulty proving that any money he puts forward to pay his $1.16 million bail did not come to him through illicit means. “We’re alleging that he received bribes, so his salary was linked to his criminal conduct,” said Deputy District Attorney Max Huntsman.
On Friday, however, he cleared that hurdle when a wealthy benefactor put up property as collateral for Mr. Noguez’s release. Mr. Huntsman said that the donor, whom he declined to identify, received no “obvious tax breaks” from the Assessor. Michael Proctor, Mr. Noguez’s attorney, said that while a number of donors pitched in to pay the bail, one donor did put in a larger amount than the rest, an amount that put Mr. Noguez over the top and paved the way for his release from jail.
The LA Times reports that Mr. Proctor has been critical of the high-bail amount and Mr. Noguez’s nearly five-month imprisonment. On Friday he said, “This is America. People are innocent until they are proven guilty. John ought to be out, and we’re happy about that.”
Mr. Noguez is at the center of a pay for play scandal set off by disclosures that a top manager in his office, Scott Schenter, 49, allegedly reduced property values by about $172 million to lower tax bills for owners of multimillion-dollar homes, condominiums and businesses in exchange for political contributions to Noguez during his campaign for the office. He told investigators in the aftermath that the pressure that came from Mr. Noguez intensified and became “brutal.” Mr. Schenter was arrested on May 21 and charged with 60 felony counts of falsifying accounts and records. If convicted he could face as many as 33 years in prison.
Mr. Noguez, a 25-year veteran appraiser and former city council member and city clerk of Huntington Park denies directing the effort to raise campaign funds by lowering property values. Mr. Noguez has acknowledged that he asked Mr. Schenter to look at some of the properties in question, but denies instructing him to reduce the owners’ taxes.
Although arrested and charged with multiple felony counts of corruption, Mr. Noguez remains the County Assessor, having stepped aside before his incarceration to take an indefinite leave of absence while the wide-ranging influence-peddling investigation of his office continued. The County Board of Supervisors do not have the authority to appoint a successor, but voted in late May 2012 to take on that authority should Mr. Noguez be unable to perform his duties for a 90 day period.
Los Angeles County Chief Executive Officer William T Fujioka recommended the appointment of Santos H. Kreimann to serve as Chief Deputy Assessor (to fill the vacancy there) and the County Supervisors approved the appointment – Mr. Kreimann is running the Assessor’s office. Still, if he chose to, Mr. Noguez could walk into the office tomorrow and take the reins. Rumors to that affect apparently had office employees on edge. County spokesman David Sommers released a statement to employees on Friday to calm the waters. “Although as an elected official Mr. Noguez has the right to immediately return to his post, I fully expect that he will remain on a voluntary leave of absence to focus on his legal issues and minimize the impact of the trial on our day-to-day operations.”
Mr. Proctor said he doubted that his client had any intention of returning to the office, as he would be working full time to clear his name.
In a West Hollywood connection, West Hollywood Mayor Jeffrey Prang, a longtime friend of Mr. Noguez (they worked together in the Assessor’s office at one tie) was hired by as Mr. Noguez’s special assistant after the scandal broke in early March.
Mayor Prang’s role has been to interface with the board of supervisors and other county agencies “to enhance the public integrity and transparency of the office.” Mayor Prang has not been implicated in any wrongdoing, nor is he a subject of the inquiry. Mayor Prang told WeHo News that his role is to keep the County Board of Supervisors abreast of goings on in the Assessor’s office and to keep them apprised of coming news stories. He remains in that position.
