Challenger, photog engage in dirty tricks

Jon Viscott, a freelance photographer who works for local publication wehoville, was caught up in an election night kerfuffle involving an incumbent, his city council deputy and a challenger that required intervention by law enforcement.


Campaign yard signs must be placed on private property with the owner's permission.

It began earlier in the day when Darran Mazaika, a resident of Wilton Manors (a part of Ft. Lauderdale, Florida), posted a grainy video on candidate Christopher Landavazo’s Facebook page accompanied by a message that read, “Christopher, this morning West Hollywood City Council Candidate John Duran was caught removing one of your campaign signs and throwing it away.” That led to a number of comments from anti-Duran activists condemning Mr. Duran for seemingly illegal activity. It is against the law to remove a campaign yard sign.

It is also, however, illegal to post signs where this one was planted, on city property. According to a city hall staffer who asked to remain anonymous, challengers during elections, “get away with all sorts of stuff the incumbents never could.” That person said, “We’ve known about Landavazo peppering the city with signs on private property without people’s permission, on buildings without landlords’ permission and on city property, but we can’t really do anything about it or the challengers claim that we’re siding with the incumbents – who are obeying the rules.”

The places from where the Landavazo signs in question were take were both on private property with the permission of the landlord and on a city-owned greensward.

The video in question, which can be seen below, shows a person removing a yard sign, however, because the video is small and so grainy upon enlargement, neither the sign nor the person removing it are unidentifiable. That did not stop Mr. Viscott from allegedly doing some more investigating. He has been a photographer for wehoville, shooting the council forum and many other campaign and other events for the newly hatched (September 2012) publication. The publication has provided challenger Steve Martin with a platform from which to campaign against Mr. Duran and has run a series of articles that portray the incumbent as in developers’ pockets.

John Duran acknowledged tossing the signage because, “it was on the property without permission and one sign was on the city’s green space at curbside.” He said that he checked with city code compliance officer Jeffrey Aubel before taking the signs down, and that Mr. Aube told him that, “as a city official I had the right and duty to throw away what the city considers litter.”

Steve Afriat, the incumbents' campaign consultant, told WeHo News, "I find this whole episode despicable.  Starting with [wehoville] seemingly conspiring with a candidate to illegally post signs, just so they can catch someone removing the signs.  BTW, they were not removing signs, they were removing litter.  To post signs on private property without permission, and public property to be removed at cost to the taxpayers is unconscionable.  And no reputable publication would encourage the type of journalism that would make a trashy tabloid blush.  Landavazo should be ashamed of this tactics of illegally posting signs, and WEHOVILLE should be ashamed of working with him to make news where there is none."

Mr. Landavazo did not reply to a request for comment on his yard sign strategy.

The council member told WeHo News that in the early evening on election night his deputy, Ian Owen, was at his residence “to pick me up and when he pulled up, Jon Viscott was in my” dumpster. When Mr. Owen approached Mr. Viscott and asked him what he was up to, Mr. Viscott said, “Are you trying to intimidate me, Ian?”

According to Mr. Duran, Mr. Owen said, “No, I just want to know what you’re doing in the councilman’s trash bin.” At that point, the photographer began snapping photos of the council deputy, who got back in his car and called the Sheriff to complain about a trespasser. The pair engaged in a “shooting” war of sorts until the Sheriff arrived and convinced Mr. Viscott to leave.

Mr. Duran said that the executive editor of wehoville sent him an E mail after the incident to say the publication had not sent the photographer, but the council member said, in light of the unfair coverage he has received from the publication, “What am I supposed to think of that – he’s your photographer.” He called the situation, “wacky,” and “weird.”

Jon Viscott did not reply to a request for comment, but wehoville’s publisher Henry Scott sought to distance the publication from Mr. Viscott, asserting that he “is not an employee of wehoville. Like some two dozen writers and photographers who sometimes provide content for us, he is a freelancer… We have no control over how freelancers live their lives.”
