The landlord people love to hate, Donald Sterling, suffered a major loss in court late last month over a fire that destroyed much of a WeHo apartment building he owns.
The real estate mogul and owner of the Los Angeles Clippers basketball team was ordered to pay an actress who said she lost most of her personal belongings - and perhaps her career - as a result of a fire in one of his apartment buildings $2.3 million in damages in December.
Robyn Cohen whose most mentioned role was Wes Anderson's comedy-drama The Life Aquatic with Steve Zissou, lived in the 54-unit Sterling-owned building at 888 W. Knoll Drive for 10 years before being burned out in a Sept. 28, 2009, blaze.
Ms. Cohen alleged that Mr. Sterling’s management company, Beverly Hills Properties, failed to keep the building in a habitable condition and that the alarm system was not operating properly at the time of the fire, which was caused by an electrical problem in a heater fan in another unit.
A Los Angeles Superior Court jury, sided with her claims and found Sterling liable for breach of contract, breach of the warranty of habitability and intentional infliction of emotional distress.
Of the total award, the jury allocated $2 million to compensate Robyn Cohen for past and future emotional distress damages.
The panel also found that Sterling and his employees acted with malice toward Cohen, triggering a second phase of trial to determine if she is entitled to punitive damages from the mega-landlord.
In that trial, the jury awarded Ms. Cohen $15 million in punitive damages.
The actress suffers from bi-polar disorder, but the property management company and Mr. Sterling belittled her claims, with Mr. Sterling shown during the trial on video tape saying, “So what?” about the building’s deficiencies and the defense attorney, Guy Gruppie, asserting that because Ms. Cohen had found some work recently that, "She is able to work and she is doing well."
Ms. Cohen and over a dozen others who were in the building the day of the fire escaped, but her unit was among 52 units in which warning horns connected to the main alarm were not working the day of the fire.
She also alleged that none of the 12 smoke detectors throughout the building were functioning.
Another resident, Kim Webster, a former cast member on The West Wing, and several other tenants also sued Mr. Sterling in Los Angeles Superior Court in January 2010, but settled with him before trial.
The woman who oversees Mr. Sterling’s real estate holdings, Philomena Wong, told the jury she did not know until months after flames damaged a West Hollywood property that the fire detection system was not fully operational.
Ms. Cohen testified that, after the fire, the building management demanded she pay the next month’s rent in advance and refused to return her security deposit when she declined.
Mr. Sterling re-entered the news this week when his son was found dead in a building he owns in Malibu.
Reports say that drug paraphernalia was also found alongside the body, but the cause of death is being withheld until the coroner’s toxicology reports can be accessed in six-eight weeks.
