The West Hollywood Planning Commission recommended at its past session that the City Council create a task force to explore ways to deal with an aging housing stock.

At the forefront of that discussion, stemming from some creative thinking on staff’s part during the El Mirador debacle, stands one solution to how to repair deteriorating housing and pay for it – allow rental units to go condo.
Brought to planning because the city’s rental housing stock is deteriorating with age, and landlords often lack sufficient means to recoup long-deferred maintenance costs from tenants, the commission expanded on that suggestion to include other measures.
In September, commission chair Alan Bernstein, an apartment management specialist, directed city staff to agendize a discussion of the concept that would, rather than apply to only a few historic buildings as staff proposed earlier this year for El Mirador, apply citywide.
The idea comes with an important caveat – that no tenants face eviction and that every tenant receive a chance to own the apartment they inhabit.
The idea came to Mr. Bernstein during the debate over incentivizing Jerome Nash’s El Mirador to help fill the historic structure more quickly after he evicted the tenants to leave the rental business, or “Ellising” the building, (incurring the Ellis Act which Mr. Nash inspired).
Even though the idea of converting rental housing stock to optional ownership/rental to fund came out of “an ordinance that we were not particularly in favor of,” according to Mr. Bernstein, still he, “thought there seemed to be a great deal of interest in discussing condo conversions.”
He called tenant protections “paramount” when considering the question.
Mr. Bernstein pointed staff Santa Monica’s Tenant Ownership Rights Charter Amendment (TORCA) as a model.
That city’s program allows rental buildings to go condo in a checker board style in which tenants who wish to remain in their units as tenants can do so until they depart.
They also have the right to purchase the units they inhabit, opening the door to homeownership for many people otherwise bereft of the opportunity to own.
Mr. Bernstein told WeHo News that “People ought to have the right to own their apartment so that they can control their home’s destiny. People who want to rent should be left in their apartment units for as long as they please.”
In addition to condo conversion, the commission recommended exploring ways to assist landlords with maintenance costs (including replacement of plumbing and electrical wiring and retrofitting buildings to meet current seismic codes) and owners' insurance coverage.
